As the federal government continues to expand upon and improve its data sharing policies over the past 20 years, complex challenges remain. Our interviews with U.S. academic genetic researchers (n=23) found that the burden, translation, industry limitations, and consent structure of data sharing remain major governance challenges.

Cells fine‐tune their DNA repair, selecting some regions of the genome in preference to others. In the paradigm case, excision of UV‐induced pyrimidine dimers in mammalian cells, repair is concentrated in transcribed genes, especially in the transcribed strand. This is due both to chromatin structure being looser in transcribing domains, allowing more rapid repair, and to repair enzymes being coupled to RNA polymerases stalled at damage sites; possibly other factors are also involved. Some repair‐defective diseases may involve repair‐transcription coupling: three (...) candidate genes have been suggested.However, preferential excision of pyrimidine dimers is not uniformly linked to transcription. In mammals it varies with species, and with cell differentiation. In Drosophila embryo cells it is absent, and in yeast, the determining factor is nucleosome stability rather than transcription.Repair of other damage departs further from the paradigm, even in some UV‐mimetic lesions. No selectivity is known for repair of the very frequent minor forms of base damage. And the most interesting consequence of selective repair, selective mutagenesis, normally occurs for UV‐induced, but not for spontaneous mutations. The temptation to extrapolate from mammalian UV repair should be resisted. (shrink)

This book explores the principal issues involved in bridging the gap between the pure theory of consumer behavior and its empirical implementation. The authors focus upon the structure of preferences, the treatment of demographic variables, the treatment of dynamics, and the specification of the stochastic structure of the demand system.

The restricted semantic ellipsis hypothesis, we have argued, is committed to an enormous number of multiply ambiguous expressions, the introduction of which gains us no extra explanatory power. We should, therefore, reject it. We should also spurn the original version since: (a) it entails the restricted version and (b) it incorrectly declares that, whenever a speaker makes an assertion by uttering an unembedded word or phrase, the expression uttered has illocutionary force.Once rejected, the semantic ellipsis hypothesis cannot account for the (...) many exceptions to the syntactic ellipsis hypothesis. The principle of the child's right to an open future was first proposed by the legal philosopher Joel Feinberg and developed further by bioethicist Dena Davis. The principle holds that children possess a unique class of rights called rights in trust—rights that they cannot yet exercise, but which they will be able to exercise when they reach maturity. Parents should not, therefore, take actions that permanently foreclose on or pre-empt the future options of their children, but leave them the greatest (...) possible scope for exercising personal life choices in adulthood. Davis particularly applies the principle to genetic counselling, arguing that parents should not take deliberate steps to create physically abnormal children, and to religion, arguing that while parents are entitled to bring their children up in accordance with their own values, they are not entitled to inflict physical or mental harm, neither by omission nor commission. In this paper, I aim to elucidate the open future principle, and consider whether it is applicable to non-therapeutic circumcision of boys, whether performed for cultural/religious or for prophylactic/health reasons. I argue that the principle is highly applicable to non-therapeutic circumcision, and conclude that non-therapeutic circumcision would be a violation of the child's right to an open future, and thus objectionable from both an ethical and a human rights perspective. Using philosophy and social science, Escape from Leviathan defends this bold, non-normative, thesis from contrary positions in the scholarly literature. The ethics of artificial intelligence (AI) is a research topic with both theoretical and practical significance. However, the ethical and moral aspects of conceptual, ontological, semantic, and knowledge modeling, more specifically, and which are sometimes found in AI applications, is not being given sufficient attention. I argue that it should. Whether considering using or developing these meaning-focused models, there are ethical aspects. This paper offers a preliminary outline about this potentially new research field, discussing: some questions and areas of concern, (...) their significance; scenarios of ethical import, and initial ethical guidelines. A focus area, potential case study, and lens through which to see the ethical significance at hand, is ontologies, with emphasis on the most abstract ontologies (so-called generic, foundational, top-level or upper ontologies). This would aim to show the ethical import of highly abstract (often philosophical) ontological choices, assumptions, and their effects on data, developers, users, and society. In particular, I stress the need for critical examination of such models, their content, their intended meanings, assumptions, ideologies, as well as the development process. Both the ethics of, and ethics in, these activities are, therefore, of interest. Topics in the ethics of AI that are relevant include: transparency, bias, data-sharing, privacy, control over data, etc. This paper thereby contributes to the ethics of AI, as well as the ethics of information, of knowledge managment and relevant topics by developing and discussing the ethics of ontology (and similar systems). Future development will refine and add to the ideas expressed in this paper. (shrink)

Boston College We need both to define our terms and to indicate whether we are using them in a normative or descriptive sense. Thus the question: "Is Christianity"—or, if you will—"Are the institutions of Christianity violent or nonviolent?" can be answered with either a Yes, or a No, or with anything in between, depending on the meaning we (...) attach to theterms "violence," "institution," and "Christianity" (Daly 1997, 321-43). When we speak normatively, or take Christianity and its institutions accordingto its best ideals, Christianity isessentially nonviolent. But when we speak descriptively, i.e., take Christianity according to what the institutions ofChristianity have actually done, and according to how those who call themselves Christian have actually acted, we can make the argument that Christianity is violent, ffanalogous distinctions can be made from within the other four traditions, this might offer a good starting point for discussion. Adapting to my purpose standard dictionary definitions, I understand violence to include in a broad way the justified or unjustified human exertion of internal or external power or force in order to achieve an injurious or abusive end, i.e., an end that is against the will, the good, or the interests of those who suffer it. (This includes all war and avoids, at least at the outset, arguments about whether a war is or can be a "just war.") I understand institution in its ordinary meaning of: any significant or established practice, relationship, structure, system, or organization in a society or culture. The following is an essay review of Paul Needham's translation of Pierre Duhem's Lemixte et la combinaison chimique and a numberof other essays. In this review we describe theintent and general features of Le mixte and try to place it in the larger context of Duhem'sprogram for energetics. The long essay (Essay3) opposing Marcellin Berthelot'sthermochemistry is singled out for detailedcommentary, since it gives Duhem's reasons forendorsing Josiah Willard Gibbs's chemicalstatics. We argue that a chemical mechanics ofa Gibbsian sort, defended in (...) Le mixte and otheressays in this volume, was the inspiration for,and basis of, Duhem's energetics. Recent theory and criticism has investigated direct and indirect exclusions. Direct exclusions expressly prevent the participation of particular individuals and groups in public discussions and debates. Prohibitions against women speaking in (...) public, for example, have served historically to inhibit women's participation in various forums (see, e.g., Landes 1998). Indirect exclusions function tacitly through discursive norms and practices that prescribe particular ways of interacting in public forums. Indirect exclusions compel participants to conform to established modes of discourse that effectively negate the perspectives and contributions of previously directly excluded individuals and groups. Calls for "objective" and "dispassionate" debate, for instance, sometimes have restricted public agendas by portraying culturally specific forms of address as universally practiced (see, e.g., Warner 1993). Indirect exclusions may regulate discourse in various forums even when direct exclusions have been counteracted. Scholarship seeking to overcome these exclusions has proceeded on two levels. On one level, scholars have recounted the efforts of excluded persons to participate in public life despite restrictions by developing alternative modes of publicity (see, e.g., Ryan 1990; Zaeske 2002). On a second level, theorists have proposed more inclusive conceptual models of the public sphere that may overcome historical exclusions of the bourgeois public sphere while retaining a commitment to critical publicity (see, e.g., Asen 1999; Benhabib 1996; Hauser 1999; Mouffe 2000).Practicing democratic discourse fairly and justly depends indispensably on enabling inclusion. Proponents of deliberative democracy argue that political legitimacy arises from processes of inclusive public debate. Seyla Benhabib asserts that "legitimacy in complex societies must be [End Page 345] thought to result from the free and unconstrained public deliberation of all about matters of common concern" (1996, 68). Others regard inclusive public discourse as crucial for the formation of affirmative individual and collective identities. Craig Calhoun faults bourgeois notions of publicity for treating "identity formation as essentially private and prior to participation in the idealized public sphere of rational-critical discourse" (1993, 274). Identity formation entails mutual recognition among members of diverse cultures, yet theorists have observed that truncated discursive processes may inhibit mutual recognition. Charles Taylor writes that practicing a politics of recognition requires an openness toward other cultures—a presumption of value tested through sustained engagement so that "what we have formerly taken for granted as the background to valuation can be situated as one possibility alongside the background of the formerly unfamiliar culture" (1994, 67). Inclusiveness is also important for individuals and groups seeking to advance self-fashioned interpretations of their interests and needs against interpretations imposed by others. Nancy Fraser explains that self-fashioning is necessary because in public debates and controversies "who gets to establish authoritative thick definitions of people's needs is itself a political stake" (1989, 164).Although inclusion is indispensable, exclusion is never total. Sometimes, people force their way into public forums and agendas. For example, participation by activists in discussions of AIDS research and treatment often has been limited by researchers' assertions of expert privilege in investigating scientific matters. Valeria Fabj and Matthew J. Sobnosky (1995) detail how AIDS activists have responded by engaging in discursive acts of redefinition and translation to gain entry into previously circumscribed forums. At other times, people surreptitiously access public arenas. Prison writing is one way that those officially banished from public view nevertheless continue to participate in oppositional discourses and movements. Gerard A. Hauser (2001) considers how dissident Adam Michnik remained a vibrant voice in Polish civil society through his writings even after his imprisonment in the 1980s by an authoritarian regime. At still other times, typically excluded people may be invited to participate in public discussions. Members of the AIDS activist group ACT UP occasionally have testified in the traditional setting of the congressional committee hearing as invited witnesses. Daniel C. Ernst Haeckel’s popular book Nat¨urliche Sch¨opfungs- geschichte (Natural history of creation, 1868) represents human species in a hierarchy, from lowest (Papuan and Hottentot) to highest (Caucasian, including the Indo-German and Semitic races). His stem-tree (see Figure 1) of human descent and the racial theories that accompany it have been the focus of several recent books—histories arguing that Haeckel had a unique position in the rise of Nazi biology during the first part of the 20th century. In 1971, Daniel Gasman brought (...) the initial bill of particulars; he portrayed Haeckel as having specific responsibility for Nazi racial programs. He argued that Darwin’s champion had a distinctive authority at the end of the 19th century, throwing into the shadows the myriads of others with similar racial attitudes.1 But it was not simply a general racism that Haeckel expressed; he was, according to Gasman (1971: 157–159), a virulent anti-Semite. Since its original publication, Gasman’s thesis has caught on with a large number of historians, so that in the present period it is usually taken as a truism, an obvious fact of the sordid history of biological thought in the first half of the 20th century.2 Perhaps the most prominent scholar—at least among historians of biology—to adopt and advance Gasman’s contention was Stephen Jay Gould. In his first book, Ontogeny and Phy- logeny (1977), Gould took as his subject Haeckel’s principle of recapitulation, the proposal that during ontogeny the developing embryo went through the same morphological stages as the phylum passed through in its evolutionary descent. So according to this conception, the human embryo begins as a one-celled creature, then takes on the form of an ancient invertebrate (e.g., a gastraea), then of a primitive vertebrate, then of an early mammal, then of a primate, and finally of a distinct.. Some state‐based newborn screening programs in the United States already use sequencing technology, as a secondary screening test for individual conditions rather than as a broad screening tool. Newborn screening programs sequence an individual gene, such as the cystic fibrosis transmembrane conductance regulator, which causes cystic fibrosis, after an initial biochemical test suggests that a baby might have a condition related to that gene. The experiences of state public health departments with individual‐gene sequencing illustrate both the usefulness of the technology (...) and its complexities. Here I discuss how newborn screening programs investigate cystic fibrosis and, as another example, adrenoleukodystrophy through individual gene sequencing. (shrink)

Many believe that the grammatical sentences of a natural language are a recursive set. In this paper I argue that the commonly adduced grounds for this belief are inconclusive, if not simply unsound. Neither the native speaker's ability to classify sentences nor his ability to comprehend them requires it. Nor is there at present any reason to think that decidability has any bearing on first-language acquisition. I conclude that there are at present no compelling theoretical grounds for requiring that transformational (...) grammars enumerate only recursive sets. Hence, the fact that proposed transformational grammars do not satisfy this requirement does not, as some have claimed, represent a shortcoming in current theory. (shrink)

The essay "Physique de croyant" is an important statement of Pierre Duhem's position on the relation between his science and his religion. Duhem trod a difficult path, some might say an impossible one, in Republican France because he was both a physicist and a devout Catholic. In this essay, using "Physique de croyant" as a touchstone, I explore the way in which he tried to reconcile his conflicting allegiances. There are several strands in Duhem's strategy that need to be teased (...) out. First, Duhem sought to defend his science against the charge that it was materialist and atheist. He did this with his claim, usually called the autonomy thesis, that physics and metaphysics are fundamentally different enterprises—that physics, properly conducted, has no metaphysical implications and requires no metaphysical support. This did not deny metaphysics its rightful territory. Second, Duhem used his segregationist position to defend the Roman Catholic Church against the assaults of the positivist scientism then in favor with the Republicans. Third, he also sought to protect his science against fellow Catholics who wanted to use it for polemical purposes. I develop and evaluate these lines of defense. (shrink)

The placebo effect is a common phenomenon in therapy and research but has received very little attention as such in nursing research. This article reviews some of the literature which shows the placebo effect, which can be positive or negative, is a significant force. Then it is argued that, while all health professionals have a general obligation to benefit their patients, nursing has a special, specific obligation to enhance the placebo effect, to maximize a positive effect and minimize a negative (...) effect. Nursing education, current policy statements, and circumstances of clinical practice explain this obligation. Nursing research is needed to clarify the multiple ways in which the social and physical environment can trigger a placebo effect. As nursing expands its knowledge of this effect, it can begin to educate patients to the self-care implications of this pervasive but misunderstood phenomenon.
